1. Eligibility & Account Security

You must be at least 16 years of age to use SceneStar. You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] of any unauthorized use of your account.

2. Prohibited Content & Acceptable Use (Ethical AI Policy)

SceneStar grants users access to advanced artificial intelligence tools for synthetic media generation. By using our Service, you agree to our Ethical AI standards. You strictly agree NOT to use SceneStar to generate, upload, or share content that:

• Depicts non-consensual explicit content, child sexual abuse material (CSAM), or unauthorized synthetic media ("deepfakes") of real individuals.
• Defames, harasses, bullies, or impersonates real individuals without their explicit, documented consent.
• Spreads political disinformation, election interference, or deceptive synthetic news.
• Violates any third-party copyrights, trademarks, or intellectual property rights.

Enforcement: SceneStar reserves the right to terminate accounts instantly, block network access, and forfeit any remaining credits without a refund if a user is found violating these acceptable use terms.

3. Ownership & Intellectual Property

Platform & Prompt Architecture: SceneStar retains all rights, title, interest, and intellectual property in and to the platform, underlying technology, creative, software, and proprietary prompt structures, templates, and generation workflows. This also includes the scenestar.io AI Smart Fix automatic job healing technology and architecture. Your use of the Service does not grant you any ownership over SceneStar's prompt structures or platform tools.

Scope of License for Generated Media: Subject to your strict compliance with these Terms, SceneStar grants you a limited, personal, non-exclusive, non-transferable license to use, share, and display media generated through the Service.

Commercial & Advertising Restrictions: You are strictly prohibited from using, licensing, or distributing media generated on SceneStar for commercial purposes, including but not limited to; advertising, endorsements, or marketing of third-party products, services, or brands. Any unauthorized commercial usage constitutes a material breach of these Terms and will result in immediate account termination.

Operational License Only: You grant SceneStar a non-exclusive, worldwide, royalty-free license to host, process, store, and reproduce your generated media solely as necessary to operate, maintain, and render the Service for you. SceneStar will never use your personal likeness or generated assets in external advertising or public marketing without your explicit permission.

4. Data Storage, Data Purging & Idle Accounts

Our storage architecture is optimized for active generation workflows, not long-term cloud archiving.

The 60-Day Idle Purge: If your account remains completely idle (defined as no user log-ins or active generation cycles) for more than 60 consecutive days, SceneStar reserves the right to automatically and permanently purge all stored images, videos, and generation histories from our secure servers.

User Responsibility: Users must download their generated videos and assets locally to their personal devices. SceneStar is not liable for any data loss resulting from automated idle account purges.

5. Copyright & DMCA Takedown Policy

SceneStar respects intellectual property rights. If you believe that any user-uploaded image or user-generated media on our platform infringes upon your copyright, please submit a formal takedown notice to our designated agent at [email protected]. Your notice must include:

• A physical or electronic signature of the copyright owner or authorized agent;
• A description of the copyrighted work claimed to have been infringed;
• The specific location/URL of the infringing material on our platform;
• Your contact information (email address and phone number);
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner; and
• A statement, made under penalty of perjury, that the information in the notification is accurate.

6. Fees, Credit Packs & Billing Disputes

• Third-Party Payment Processors: All financial transactions are securely processed by our third-party payment processor, Stripe. By purchasing credit packs, you agree to Stripe’s terms of service and billing policies. SceneStar does not store full credit card numbers on our servers.
• Credit Packs & Pay-As-You-Go: SceneStar operates strictly on a credit-based model. Users purchase credits via one-time credit packs. There are no recurring subscription fees or automatic renewals.
• Refund Policy: All sales of credit packs are final. SceneStar cannot offer refunds or cash exchanges for credits once a purchase transaction has been completed or credits have been allocated. The exception to this is for a block that fails the auto-healing and manual-healing processes and cannot be successfully completed.
• Chargebacks & Payment Disputes: If you experience an issue with a transaction, you agree to contact [email protected] first to resolve the matter. Initiating an unauthorized chargeback or payment dispute with your bank or credit card company without contacting support may result in immediate permanent account suspension, forfeiture of remaining credit balances, and restriction from future platform access.

7. Limitation of Liability & Disclaimers

SceneStar provides AI generation tools on an "as-is" and "as-available" basis. We do not guarantee the absolute accuracy, consistency, or appropriateness of the AI-generated outputs. SceneStar is not responsible or liable for how users distribute, share, or publish media generated on our platform. To the maximum extent permitted by law, SceneStar shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

8. Governing Law & Dispute Resolution

• Governing Law: These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.
• Jurisdiction: You irrevocably agree that the courts of New Zealand shall have exclusive jurisdiction to settle any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service.
• Local Consumer Protections: If you use the Service as a consumer located in a jurisdiction outside New Zealand, you may be entitled to mandatory statutory rights under your local consumer protection laws. Nothing in these Terms is intended to limit or exclude rights that cannot be lawfully excluded under applicable local law.
• Changes to Terms: We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Effective Date" at the top of this page. Continued use of the Service following any changes constitutes your acceptance of the new Terms.
